LIABILITY WAIVER AND RELEASE OF CLAIMS AGREEMENT

PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR RIGHTS.

I {first_name}, the undersigned participant (hereinafter referred to as the “Member”), acknowledge and agree as follows:

1. Assumption of Risk

I understand that participation in Brazilian Jiu-Jitsu, submission wrestling, martial arts, fitness training, and related activities at Gerringong Jiu Jitsu Academy (hereinafter referred to as “GJA”) involves inherent risks of injury. These risks include, but are not limited to: sprains, strains, fractures, dislocations, concussions, cuts, bruises, serious bodily injury, permanent disability, or death.

I further understand that risks may also arise from my own actions, the actions or negligence of others, the condition of the training environment, or the use of equipment. By signing this waiver, I voluntarily assume all risks, known or unknown, associated with participation in GJA activities.

2. Release of Liability

In consideration of being permitted to participate in classes, events, training, and activities at GJA, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, discharge, and hold harmless:

• Gerringong Jiu Jitsu Academy, its owners, directors, officers, instructors, coaches, employees, contractors, agents, and volunteers (collectively, the “Released Parties”)

from any and all claims, demands, actions, or causes of action for personal injury, property damage, wrongful death, or other losses arising out of or in connection with my participation in GJA activities, whether caused by negligence of the Released Parties or otherwise.

3. Waiver of Claims

I expressly waive any right to sue or bring legal action against the Released Parties for injuries, damages, or losses sustained as a result of my participation in GJA activities, including those arising from the ordinary negligence of the Released Parties.

4. Medical Treatment & Responsibility

In the event of injury or illness, I authorize GJA staff or representatives to arrange emergency medical care as deemed necessary. I accept full financial responsibility for all costs related to such treatment and acknowledge that GJA is not liable for any medical expenses incurred.

5. Image and Video Release

I grant Gerringong Jiu Jitsu Academy the unrestricted right to capture photographs and video recordings of me during training, classes, and events. I consent to the use of these images for promotional, educational, or marketing purposes across digital platforms (including but not limited to Facebook, Instagram, TikTok, websites, and printed media). I waive any right to inspect, approve, or receive compensation for the use of such materials.

6. Compliance with Rules

I agree to comply with all GJA rules, policies, and safety guidelines, including hygiene, conduct, and training protocols. I understand that failure to comply may result in suspension or termination of my membership without refund.

7. Acknowledgement of Understanding

I acknowledge that I have read and understood this Liability Waiver and Release of Claims Agreement in full. I am aware that by signing this document I am giving up certain legal rights, including the right to sue the Released Parties. I sign this agreement freely and voluntarily.

Electronic Consent

By affixing my electronic or written signature below, I confirm that I have read, understood, and agreed to the terms of this waiver. I acknowledge that this agreement constitutes a legally binding contract between myself (the “Member”) and Gerringong Jiu Jitsu Academy (GJA).

PARENTAL CONSENT TERMS AND CONDITIONS FOR CHILD PARTICIPATION

1. Assumption of Risks: I, the undersigned parent or legal guardian, acknowledge that the participation of my minor child, [Child's Full Name], in the [Activity/Event] organized by [Your Name/Organization] involves certain inherent risks and hazards. I understand that these risks may include, but are not limited to, physical injury, illness, and property damage.

2. Release and Waiver of Claims: In consideration for allowing my child to participate in the aforementioned activity, I hereby release, discharge, and hold harmless [Your Name/Organization], its instructors, employees, volunteers, and any other representatives (collectively referred to as the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by my child while participating in the activity.

3. Medical Authorization: I grant permission for the designated representatives of [Your Name/Organization] to seek and obtain medical treatment on behalf of my child in the event of any injury or illness during the activity. I understand that every effort will be made to contact me or the emergency contact listed, and I agree to be financially responsible for any costs associated with such treatment.

4. Compliance with Rules: I acknowledge and agree that my child will comply with all rules, policies, and guidelines established by Gringo Jiu Jitsu for the activity. I understand that failure to comply may result in my child's removal from the activity without refund.

5. Image and Video Release: I hereby grant Gringo Jiu Jitsu the right to take photographs and videos of my child during the activity. I understand that these materials may be used for promotional or educational purposes, including but not limited to, social media (such as Facebook, Instagram, Twitter), websites, and other marketing materials.

6. Emergency Contact Information: I will provide accurate and up-to-date emergency contact information for my child. In the event of an emergency, [Your Name/Organization] will make reasonable efforts to contact me or the designated emergency contact.

7. Agreement to Notify of Changes: I agree to promptly notify Gringo Jiu Jitsu of any changes to my contact information or my child's health that may affect their participation in the activity.

8. Governing Law: This Parental Consent and Waiver shall be governed by and construed in accordance with the laws of NSW, Australia.

Cancellation Policy:

• Members may request to cancel their membership by providing written notice to Gringo Jiu Jitsu at least 30 days prior to the desired cancellation date.
• Membership fees for the current month are non-refundable, and the membership will remain active until the end of the 30-day notice period.
• Failure to provide the required 30-day notice may result in membership fees being charged for the subsequent month.

I have read and understand these terms and conditions, and I voluntarily sign this Parental Consent and Waiver with the knowledge that I am waiving certain legal rights on behalf of my minor child.

Terms and Conditions for General Members

Gerringong Jiu Jitsu Academy (GJA)

1. Membership Agreement

By becoming a member of Gerringong Jiu Jitsu Academy (GJA), you agree to abide by these Terms and Conditions, as well as any additional rules, policies, or guidelines established by GJA. These terms apply to all members and visitors participating in classes, programs, or activities at the Academy.

2. Use of Facilities

• Members are entitled to use GJA’s facilities solely for participation in Jiu-Jitsu classes, training, and related activities.

• Members must follow designated schedules, class times, and instructor guidance.

• Unauthorized use of facilities, equipment, or property is prohibited.

3. Code of Conduct

• Members must conduct themselves with respect, courtesy, and professionalism at all times.

• Disruptive behavior, harassment, bullying, or inappropriate conduct toward fellow members, instructors, or staff will not be tolerated.

• Any violation of this code may result in immediate suspension or termination of membership, at GJA’s discretion.

4. Safety and Health

• Members participate in Jiu-Jitsu and related activities at their own risk.

• Members must follow all safety instructions from instructors and staff.

• Proper training attire and hygiene standards are mandatory.

• Members must inform instructors of any injuries or medical conditions that may affect participation.

• GJA is not responsible for injuries sustained while training, and all members must sign a Liability Waiver prior to participation.

5. Payment and Fees

• Membership fees must be paid in accordance with the selected membership plan.

• All fees are non-refundable and non-transferable, except in exceptional circumstances at GJA’s discretion.

• Failure to make timely payments may result in suspension or cancellation of membership.

6. Cancellation and Suspension

• Members may cancel their membership by providing 30 days’ written notice to GJA.

• Membership fees for the current billing cycle are non-refundable, and the membership remains active until the end of the notice period.

• GJA reserves the right to suspend or terminate memberships for reasons including, but not limited to:

  • Non-payment of fees

  • Breach of these Terms and Conditions

  • Unsafe, disruptive, or disrespectful conduct

7. Intellectual Property

• All intellectual property rights, including but not limited to trademarks, logos, branding, class materials, and instructional content, remain the sole property of GJA.

• Members may not reproduce, distribute, or use GJA’s intellectual property without prior written consent.

8. Liability Waiver

• All members are required to sign GJA’s Liability Waiver and Release of Claims Agreement prior to participation.

• By signing, members acknowledge and accept the risks associated with martial arts training.

9. Updates and Amendments

• GJA reserves the right to update, amend, or modify these Terms and Conditions at any time.

• Members will be notified of any material changes. Continued participation after such changes constitutes acceptance of the updated terms.

10. Cancellation Policy

• Members wishing to cancel must provide at least 30 days’ written notice.

• Membership fees already paid are non-refundable.

• Failure to provide sufficient notice may result in additional fees being charged for the subsequent billing cycle.

By becoming a member of Gerringong Jiu Jitsu Academy, you acknowledge that you have read, understood, and agreed to abide by these Terms and Conditions.
